We process personal data that we receive in connection with the establishment or implementation of a customer relationship with you. This includes in particular

- the language level and the needs regarding the language course or coaching

3. What do we process your data for (purpose of processing) and on what legal basis?

Your personal data is processed exclusively for the provision of the services contractually agreed between us (language courses, coaching). The following applies:

a) Based on your consent to data processing (Art. 6 (1) (a) GDPR): If and insofar as you have given your consent to the processing of personal data, the respective consent is the legal basis for the processing referred to therein. This applies, for example, to the receipt of electronic information from us. b) For the fulfilment of contractual obligations (Art. 6 para. 1 letter b GDPR): Your data will be processed for the initiation or performance of our contractual relationship with you, i.e. for the performance of a language course, for example.

c) As part of the balancing of interests (Art. 6 para. 1 letter f GDPR): Your data may also be used on the basis of a balancing of interests to protect our legitimate interests. This is done, for example, for the purpose of ensuring IT security and IT operations or, if necessary, the assertion of legal claims and defence in legal disputes.

4. To whom do we pass on the data?

In principle, we do not pass on your personal data to third parties, with the exception of the following cases:

a) For the purpose of maintaining our IT infrastructure and data management, external bodies (e.g. IT service providers) may be given access to personal data; however, only ever if they have been contractually obliged by us to fulfil their special obligations as processors (Art. 28 GDPR) and guarantee that they have taken special precautions to protect your data.

b) Furthermore, it is possible that personal data may come to the knowledge of persons professionally obliged to maintain confidentiality (tax consultants) in the context of the fulfilment of our tax obligations.

c) In the event of a legal dispute, data may be passed on to the lawyers assigned to the case.

d) Cisco Webex services are used for the purpose of conducting online courses. In order to send invitations and participate in online meetings, it is necessary to process your email address.

5. Do we transfer data to third countries?

No, not at Heather Language Training. Your data will only be processed within the European Union and countries within the European Economic Area (EEA). Otherwise, we will always inform you separately in advance, including your right to object to such data transfer at any time.With regard to the technically necessary transfer, processing or storage of certain data such as IP address, operating system or browser by other services due to the use of the website or the use of the contact form, please see below under Privacy Policy for our website, point 4.

6. How long do we store your data?

We store your data as follows:
a) Initially for the period in which we provide the services we offer to you. In addition to the duration of the contractual relationship, this also includes data collected or transmitted by you in connection with service and product-related enquiries. These will be deleted at the point in time from which they are no longer necessary for processing the enquiry and fulfilling the purpose (e.g. if it is clear from the circumstances that no further correspondence with the enquirer is necessary).
b) If the data is related to tax-relevant transactions, it will be stored for a period of 10 years after the end of the respective calendar year;
c) Furthermore for the duration of possible mutual claims after the provision of our services (statutory limitation period: generally 3 years beginning at the end of the calendar year in question).

7. Is there an obligation to provide personal data?

You are under no real obligation to provide personal data. However, without this data we are generally unable to conclude and fulfil a contract with you, i.e. we are unable to provide our services to you.

8. Do we use automated decision-making?

We do not use automated decision-making in accordance with Art. 22 GDPR to establish and conduct the business relationship. Should we ever use such procedures in individual cases, we would inform you of this separately.

9. To what extent do we use your data for profiling?

We do not use so-called ‘profiling’ in accordance with Art. 4 No. 4 GDPR as part of our contractual relationship.
